Liability solution for international property transaction

Swiss North American Properties (SNAP) was in the process of acquiring a large portfolio of chemical manufacturing properties. The environment at four of these properties was potentially impaired and the seller wanted to be sure the liabilities would not return. An Environmental Liability Solution was designed that allowed SNAP to responsibly and comprehensively remediate the sites and the seller recognized the mitigation of their environmental liabilities.

We recently facilitated the redevelopment of a number of dormant properties in downtown Buffalo, New York.  A site specific transaction company was set up and entered into agreements to manage, remediate, and assume liability for the environmental conditions at these former industrial and commercial properties.  Our liability transfer structure protected the sellers, the purchaser and future occupant of the property against liabilities for the environmental conditions.
